These Terms and Conditions ("Terms") govern use of this website and purchase of digital IT services from MKK Digital Services (legal name: Sahil Farooqui), C68 Shaheen Bagh, Okhla, New Delhi 110025, India. By accessing the website or placing an order you agree to these Terms and our Legal Compliance page.

1. Legal framework

These Terms are governed by the laws of India, including the Indian Contract Act, 1872; Information Technology Act, 2000; Consumer Protection Act, 2019; Consumer Protection (E-Commerce) Rules, 2020; and other applicable statutes. Full compliance disclosures are on the Legal Compliance page.

2. Eligibility

• You must be at least 18 years of age and competent to contract under the Indian Contract Act, 1872.
• You must provide true, accurate, and complete information at checkout.
• If you buy on behalf of a company, you represent that you are authorized to bind that company.

3. Services offered

• We offer digital IT consultancy and related professional services as listed on the Shop and product pages (website development, software consulting, support retainers, etc.).
• Each product page describes inclusions, exclusions, price in INR, delivery timeline, and support.
• We do not sell illegal or restricted products/services under Indian law.

4. Orders, pricing and payment

• Prices are shown in Indian Rupees (INR). GST may apply as per GST law and will be disclosed where required.
• An order is placed when you complete checkout and initiate payment.
• Payment may be collected via UPI and/or licensed payment gateways / aggregators as enabled.
• You agree not to share banking OTP/MPIN with anyone claiming to represent us.
• We may cancel orders that appear fraudulent or in violation of law.

5. Delivery of digital services

• Services are delivered digitally (email, remote sessions, published website handoff, documents) as stated on the product page.
• Timelines start after payment confirmation and receipt of required client materials.
• See product pages and any delivery / shipping policy for typical durations.

6. Customer obligations

• Provide content, access, and decisions reasonably required for delivery.
• Do not use services for unlawful purposes under Indian law.
• Respect intellectual property of third parties when supplying materials to us.

7. Intellectual property

• Until full payment is received, work product remains our property.
• After full payment and final delivery of agreed assets, you receive rights as described for that package (typically a license or ownership of custom deliverables created for you, excluding our pre-existing tools/templates).

8. Refunds and cancellation

Refunds and cancellations are governed by our Refund Policy and Cancellation Policy, consistent with the Consumer Protection Act, 2019 and e-commerce rules where applicable.

9. Limitation of liability

• To the extent permitted by law, our total liability for any claim relating to a service is limited to the amount paid for that service.
• We are not liable for indirect, incidental, or consequential losses, loss of profit, or loss of data, except where liability cannot be excluded under Indian consumer law.
• Nothing in these Terms limits rights that cannot be waived under the Consumer Protection Act, 2019.

10. Privacy

Processing of personal data is described in our Privacy Policy, aligned with the IT Act, 2000 and applicable data protection law including the Digital Personal Data Protection Act, 2023 as applicable.

12. Governing law and jurisdiction

We may update these Terms by posting a revised version on this page. Continued use after updates constitutes acceptance of the revised Terms.
